Site Incident -- Reporting & COIDA Claim

Someone has been hurt on site, or worse. There are two duties: report it to the Department of Employment and Labour, and lodge the COIDA claim so the worker is covered. The order and the rules.

    Straight away

    • Make the casualty and the scene safe; call 10177 for an ambulance if needed
    • For a death or serious injury, do not disturb the scene until an inspector authorises it (except to free or treat the injured)

Report to the Department of Employment and Labour (OHS Act)

Death, serious injury or dangerous occurrence Report to the DEL / provincial inspector -- the most serious cases as soon as practicable
Records Keep the incident record and the investigation findings on file

COIDA -- the workers' compensation claim

Cover COIDA covers work injuries and pays instead of the worker suing the employer (no double-insure)
Temporary disablement benefit Up to 75% of earnings, for up to 12 months (extendable to 24)
Who fronts the first part The employer generally pays the first 3 months, then claims it back from the Compensation Fund
Lodge with The Compensation Fund -- you need a valid Letter of Good Standing to claim
Reference only -- not legal advice. The exact DEL reporting timeline depends on the severity (an Annexure 1 report applies to certain incidents) -- confirm the current wording with the DEL. For a life-threatening emergency call 10177 first.
