    Get an indicative B-BBEE category and level for a South African contractor under the Construction Sector Code.

    What this tool does

    Classifies a contractor as Exempted Micro Enterprise (EME), Qualifying Small Enterprise (QSE) or Generic, and applies the deemed B-BBEE level (Level 1 for 100% black-owned EMEs and QSEs; Level 2 for 51% to 99%) where the sector code allows. Generic entities need a full scorecard.

    A full B-BBEE scorecard (ownership, management, skills, ESD, SED) is needed for Generic entities and for an EME or QSE that wants to claim a level better than the deemed level.

    What the law actually says

    • The Broad-Based Black Economic Empowerment Act 53 of 2003 and the Codes of Good Practice (gazetted in 2013, amended) set out the EME, QSE and Generic categories.
    • The Construction Sector Code (gazetted under section 9(1)) sets sector-specific thresholds: EME under R10m turnover (R6m for BEPs); QSE R10m-R50m (R6m-R25m for BEPs); Generic above R50m (R25m for BEPs).
    • EMEs and QSEs that are 100% black-owned are deemed Level 1; those that are 51% or more black-owned are deemed Level 2. Both are verified by sworn affidavit, not by a SANAS verification agency.
